By the impugned order, the learned court below has issued the direction to the defendant-petitioners for deposit of the current rent as well as arrears of rent under Section 15 of the Bihar Buildings (Lease, Rent and Eviction) Control Act. Learned counsel for the petitioners has submitted that the only illegality committed by the learned court below is that the Annexure-1 to this writ application has not been considered. Learned counsel for the petitioner has further accepted that the direction for
Patna High Court CWJC No.10673 of 2014 dt.05-07-2016 depositing current rent including arrears of rent has not been complied by the petitioner so far.
After considering the aforesaid submissions and the perusal of the impugned order, this Court is not inclined to invoke the jurisdiction under Article 227 of the Constitution of India. The present application is, accordingly, dismissed. However, the learned court below is directed to expedite the disposal of the suit as it is an eviction suit. (V.
