The petitioners are apprehending their arrest in connection with Hilsa P.S.Case No.361/2015 , registered for offences punishable under Sections 147, 148, 149, 323, 337, 353, 427, 283, 332, 307, 504 of the Indian Penal Code and Sections 3⁄4 of the Damage to the Property Act. And Section 151 of the Railway Act, 1989.

Prosecution story is that the petitioners, several other office bearers of D.P.S. School and other accused persons obstructed the road and also caused brick batting. Submission of the learned counsel for the petitioners is that 300-400 persons have been made accused including the persons named in the FIR, no specific allegation has been

No.24457 of 2019(3) dt.14-05-2019 2/2 attributed against them and considering the same, some of the persons have been granted privilege of anticipatory bail, vide order dated 4.4.2019 passed in Cr. Misc. No.19785 of 2019 and order dated 26.3.2019 passed in Cr. Misc. No.16884 of 2019 by a Co-ordinate Bench of this Court.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Hilsa, Nalanda in connection with Hilsa P.S.Case no.361 of 2015, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

With the aforesaid direction, this application is allowed.
