JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 13-07-2017 Heard the Counsel for the petitioner and the informant. Petitioner is facing accusations punishable under Section 304B and 201/34 of the Indian Penal Code vide Agion Bazar P.S. Case No. 61 of 2016.

Within four months of the marriage of the victim with the son of the petitioner, the deceased was done to death in suspicious circumstances while she was living in her matrimonial home. The dead body was also disposed of. Contention of the petitioner is that there is delay of 15 days in lodging the F.I.R.. The father (informant) was duly informed about the death of the victim by electric shock. He has also participated in the cremation. Counsel for the informant opposed the prayer and submits that witnesses, in course of investigation, have supported the prosecution case. The presumption of law in such case is

Patna High Court Cr.Misc. No.24895 of 2017 (2) dt.13-07-2017 2/2 against the petitioner.

Considering the allegation levelled against the petitioner and the other materials reflected from the record, I am not inclined to direct release of the petitioner on anticipatory bail. Prayer is rejected.
