The petitioners seek bail in Hisua P.S. case no. 276 of 2018 instituted for the offence under Sections 302/34 of the Indian Penal Code.
In the written report, it is alleged that police got information that villagers have caught one thief and he is being assaulted. On getting this information, police reached at the place of occurrence and apprehended the petitioners who were running away on seeing the police party. The petitioners disclosed before the police that on alarm being raised from the house of one Ranju Devi and Sanjay Rajbanshi , villagers
Patna High Court Cr.Misc. No.79135 of 2018(2) dt.23-01-2019 2/2 gathered and caught a thief who disclosed his name Rupan Manjhi @ Asharbha to whom villagers brutally assaulted on account of which he became unconscious. He was taken to hospital where he died during course of treatment. It is alleged in the written report that besides these three petitioners total 21 other accused persons have assaulted the aforesaid Rupan Manjhi @ Asharbha.
Petitioners are in custody since 19.9.2018.
Considering the aforesaid, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of the C.J.M. Nawada in connection with Hisua P.S. case no. 276 of 2018 subject to the condition that both the bailors shall be the close relative of the petitioners.
