Let the defect(s), if any, be removed within a period of four weeks from today.

This application is filed for grant of regular bail in connection with POCSO Case No. 03 of 2023 registered under section 363, 366A, 34 of the Indian Penal Code. Learned counsel for the petitioner submits that petitioner along with three unknown boys have enticed the daughter of the informant and also the petitioner is in custody since 08.09.2022.

Learned A.P.P. has vehemently opposed the prayer for bail.

Considering the period of custody and the nature of

Patna High Court CR. MISC. No.25246 of 2023(2) dt.23-05-2023 2/2 allegations levelled against the petitioner, this application for regular bail is allowed.

Let the petitioner, above named, be released on bail after framing of charge if the charge is not framed yet and on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-VII-cum-Exclusive Special Judge, (POCSO Act), Sasaram (Rohtas) in connection with POCSO Case No. 03 of 2023.

Since the petitioner is from Uttar Pradesh, the Court below is directed to verify the recent address of the petitioner before releasing him and both the bailors should be blood relative of the petitioner.

The petitioner is directed to cooperate in the trial. If the petitioner does not cooperates in the trial, the Court below is at liberty to cancel the bail bonds of the petitioner. (Sandeep Kumar, J) Sunnykr/- U T
