BAJANTHRI) Date : 25-07-2025 The petitioners-Union of India have assailed the order of the Central Administrative Tribunal, Patna Bench, Patna, dated 22.05.2024 passed in O.A. No.050/00564/2023.

2. The respondent no.1-Subir Kumar Bandhopadhyay invoked remedy under Section 19 of the Administrative Tribunals Act, 1985, seeking certain reliefs relating to grant of increments, which were extended to him and it was alleged to be

Patna High Court CWJC No.7328 of 2025 dt.25-07-2025 2/2 in excess. In such matters, the Hon'ble Supreme Court have already examined in number of cases as is evident from the order dated 22.05.2024 passed by the Central Administrative Tribunal, Patna Bench, Patna, in O.A. No.050/00564/2023, like M.R. Gupta versus Union of India & Ors, reported in (1995) 5 SCC 628, Ashok Kumar Jha versus State of Bihar, reported in 2019(1) PLJR 361, State of M.P. Versus Yogendra Shrivastava, reported in (2012) 12 SCC 538 and Union of India and others versus Tarsen Singh, reported in (2008) 8 SCC 648.

In the light of the principles laid down in the aforementioned judicial pronouncements, the petitioners have not made out a case so as to interfere with the order dated 22.05.2024 passed by the Central Administrative Tribunal, Patna Bench, Patna, in O.A. No.050/00564/2023, on the sole ground of delay in filing Original Application by the respondent no.1Subir Kumar Bandhopadhyay. Accordingly, the present writ petition stands dismissed.
