ANJANA MISHRA ORAL ORDER 11-11-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Alamganj P.S. Case No.174 of 2015 for allegedly having committed the offence under Section 306 of the Indian Penal Code.

Diary in the present case was called for, which has since been received.

Learned counsel for the petitioner submits that the case is one of suicide as it has been registered on the basis of suicide note recovered from the pocket of the deceased. It is further submitted that only because it is alleged that the petitioner and one Banti had given threatening to the deceased,

Having heard learned counsel for the petitioner and the learned counsel for the State, who has perused the case diary, it appears that there is no cogent material on the record to prove that the petitioner has given such threats. In view of such facts and circumstances and also because the petitioner has no criminal history, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Patna City, in connection with Alamganj P.S. Case No.174 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
