The petitioner seeks bail in Gandhi Maidan P.S. Case No. 274/2018, G.R. No. 4200/2018, instituted for offences under Section(s) 406, 420/34 of the Indian Penal Code. Learned counsel for the petitioner has submitted that fake allegation has been levelled against this petitioner. It is alleged in the written report that informant is cashier in Ashiana Hyundai company. Petitioner was working as vehicle registration agent in the aforesaid company, who used to work in the dealership of informant. It is alleged that Dinesh Kumar kept his brother Ramesh Kumar and Sunil Kumar for help in doing registration. It is further alleged that on 27.06.2018, Dinesh Kumar was contacted for doing registration
Patna High Court CR. MISC. No.24387 of 2019(2) dt.16-04-2019 2/3 then he told the informant to go to Biscomaun and give money to Ramesh and Sunil, who will deposit the receipt after registration. Thereafter informant went to Biscomaun and gave them Rs. 13,64,044/- for doing registration and returned to his office but deposit receipt was not given till evening. Thereafter informant contacted Dinesh Kumar on mobile, but the same was not received by Dinesh Kumar. The informant went to Sarai, Danapur and met Mahesh Kumar, brother of Dinesh Kumar, who told that Dinesh Kumar has not come. The informant raised suspicion that Dinesh Kumar, Ramesh Kumar and Sunil Kumar have taken registration money amounting to Rs. 13,64,044/-. Learned counsel for the petitioner has submitted that aforesaid Dinesh Kumar and Sunil Kumar have already been granted bail by different Benches of this Court vide Cr. Misc. No.68679/2018 and 78916/2018 respectively.
Petitioner is in custody since 17.01.2019.
Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Judge
