The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 20B (ii) (c)/22 of the NDPS Act.

As per FIR, the petitioner and co-accused persons were apprehended on the spot along with a vehicle bearing Reg. No. BR05PB-1087 and on search two mobiles from the petitioner and from co-accused, namely, Suresh Yadav 100 gram smack and from another co-accused, namely, Bittu Kumar Singh a bag in which 3.5 kg ganja like substance was recovered.

As per Annexure-2 the petitioner is owner of the alleged vehicle due to which he has falsely been implicated in this case. The petitioner has no concern with the alleged recovery and nothing incriminating article has been recovered from his conscious possession. He has got no criminal antecedent. It is further submitted that 100 gram smack and 3.5 kg ganja like substance which were recovered from co-accused persons does not come within the purview of commercial quantity. The petitioner is languishing in judicial custody since 08.01.2023.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Chhatauni P.S. Case No. 08 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like
