JUSTICE SUDHIR SINGH ORAL ORDER 17-03-2016 Heard learned counsels for the petitioner, informant and learned counsel for the State.
The petitioner is apprehending his arrest in connection with Muzaffarpur Town P.S. Case No. 357 of 2014 for the offences instituted under Sections 498(A), 379 of the IPC and 3⁄4 of the D. P. Act.
The accusation is of torture by the accused persons to the informant for non-fulfilment of dowry demand. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The petitioner is the husband of the informant. The petitioner is ready to keep the
Patna High Court Cr.Misc. No.51115 of 2014 (4) dt.17-03-2016 2/2 informant with him with all dignity and respect. Learned counsel for the informant is also present. He has also expressed his willingness to stay with the petitioner.
On behalf of the State it has been submitted that the petitioner is named in the F.I.R. and he is the husband of the informant.
Considering the aforesaid fact that both the parties have agreed to stay together, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Muzaffarpur Town P.S. Case No. 357/2014 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Muzaffarpur, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
