====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 15-01-2019 Heard learned counsel for the petitioners and the State.
The petitioners seek bail in Marhowrah P.S. Case No. 309 of 2018, instituted for the offence under Sections 399, 402, 414 of the Indian Penal Code, Sections 25(1-b)a, 26 and 27 of the Arms Act.
Counsel for the petitioners submits that petitioners were not apprehended on spot. The name of petitioners has been disclosed by co-accused Nanhki Nut who has been apprehended by the police on spot. Counsel for the petitioners further submits that co-accused Nanhki Nut @ Sunil has been granted bail by this Court vide order dated 10.10.2018 passed in Cr. Misc. 57099 of 2018.
Patna High Court Cr.Misc. No.1860 of 2019(2) dt.15-01-2019 2/2 Petitioners are in custody since 5.11.2018 having clean antecedent.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioners is allowed. Let the petitioners above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VIII, Saran, in connection with Marhowrah P.S.
