====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 03-08-2023 Heard learned counsel for the petitioner and the State.
2. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 379 and 420 of Indian Penal Code.
3. Learned counsel appearing for the petitioner denies the prosecution case however, he submits that the petitioner is ready to pay 50% of the total amount of Rs. 31,300/- (thirty one thousand three hundred) i.e., Rs. 15,650/- (fifteen thousand six hundred fifty) at the time of furnishing the bail bond to the court below and rest amount of Rs. 15,650/- (fifteen thousand six hundred fifty) within two months thereafter.
4. Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of six
Patna High Court CR. MISC. No.24467 of 2023(4) dt.03-08-2023 2/2 weeks from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari, East Champaran in connection with Phenhara P. S. Case No. 07 of 2020, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure with further condition that the petitioner shall refund Rs. 15,650/- (fifteen thousand six hundred fifty) through Bank Draft to the court below at the time of furnishing bail-bond and rest amount i.e., Rs. 15,650/- (fifteen thousand six hundred fifty) within a period of two months from the date of furnishing bail-bond, failing which, the learned court below would be at liberty to cancel the bail-bond.
5. It is made clear that without going into the merit of the case, this order has been passed for the purpose of bail and payment of aforesaid amount shall be subject to the final outcome of the case.
