JUSTICE SHIVAJI PANDEY ORAL ORDER 17-08-2017 Heard learned counsel for the petitioner and learned counsel for the State.

In this case, the petitioner is seeking anticipatory bail in connection with Babubarhi P.S. Case No. 144 of 2016, registered for the offence punishable under Sections 461, 379, 411 and 120B of the Indian Penal Code.

As per the allegation, Police has intercepted a Tempo from there an old Parvati statue was recovered. The petitioner along with others was sitting in the Tempo.

As there is direct allegation against the petitioner, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for anticipatory bail is rejected. If the petitioner surrenders before the Court below within four weeks from today,

Patna High Court Cr.Misc. No.26383 of 2017 (3) dt.17-08-2017 2/2 the court below will pass the order without being prejudiced to the order passed by this Court.
