Petitioner is apprehending arrest in connection with Chapra Town P.S. Case No. 270 of 2020 for the offence under sections 272, 273 of the Indian Penal Code and Sections 30(a), 41(i) (ii) of the Bihar Prohibition and Excise Act. In the instant case total 15.375 liters of foreign liquor was seized from a plastic sack kept on a motorcycle. Learned counsel for the petitioner submits that one person was apprehended by the police in this case who disclosed the name of the petitioner. He further submits that the motorcycle does not belong to the petitioner and he has no concern with the seized liquor.
Considering the fact that in the instant case 15.375
Patna High Court CR. MISC. No.21627 of 2020(2) dt.13-08-2020 2/2 liters of foreign liquor was seized from the motorcycle which does not belong to the petitioner, the Court is inclined to grant anticipatory bail to the petitioner, let the petitioner, named above, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Saran at Chapra, in connection with Chapra Town P.S. Case No. 270 of 2020 subject to the condition as laid down under section 438(2) of the Cr.P.C. with further condition that the petitioner shall deposit Rs. 25000/- cash before the court below and the amount deposited by the petitioner shall abide by final outcome of the pending criminal case.
