JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-02-2019 Earlier prayer for bail of the petitioner was rejected twice, firstly vide order dated 03.02.2017 passed in Cr. Misc. No. 53853 of 2016 and secondly vide 03.01.2018 passed in Cr. Misc. No. 60449 of 2017.

Allegation against the petitioner and other accused persons is of indiscriminate firing causing death of the two police personnel and apart from this the petitioner is accused in a large number of cases altogether 9 cases.

Submission of learned counsel for the petitioner is that the petitioner is in judicial custody for about two and half years and up till now no substantial progress has been made in the trial and in four cases, the petitioner has been acquitted and in rest of the cases, he is on bail.

Heard learned A.P.P. also.

No.836 of 2019(4) dt.27-02-2019 2/2 Having heard both sides and perused the record, it appears that four witnesses have been examined and the court is taking step for examination of other witnesses, in such view of the matter, I am not inclined to grant bail to the petitioner, however, the learned trial court is directed to expedite the trial and Senior Superintendent of Police, Gaya, is also directed to produce the fact that the petitioner is in custody for about two and half years.

Accordingly, this application is dismissed.
