JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-01-2019 This application, for grant of anticipatory bail, arises out of Masaurhi P.S. Case No. 480 of 2018, disclosing offences under Sections 30 (a) Bihar Prohibition and Excise Act, 2016. Allegation is of recovery of 100 k.g. of mahua flower and 1.5 litres of liquor.

Submission of learned counsel for the petitioner is that he has falsely been made accused in this case and in fact nothing has been recovered either from the possession of the petitioner or from his house rather the recovery has been made from an open shed.

Heard learned A.P.P. also.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within

Patna High Court Cr.Misc.
