The petitioner apprehends his arrest in Thawe P.S. Case No.51 of 2018 registered under Sections 323, 498A, 406, 314 and 34 of the Indian Penal Code and sections 3⁄4 of the Dowry Prohibition Act.
Learned counsel for the petitioner submits that petitioner was granted anticipatory bail by learned Sessions Judge, Gopalganj vide order dated 08.06.2018. The petitioner filed a petition stating that the petitioner is unable to pay the maintenance of Rs.7,000/- per month to his wife. The same petition was disposed of vide order dated 04.07.2018 on the ground that petitioner did not file any petition either for
Patna High Court Cr.Misc. No.80125 of 2018(2) dt.15-01-2019 2/2 modification of any conditions imposed by the court below on 08.06.2018 or for extension of period of his surrender in the court below.
Since the petitioner is still on anticipatory bail, this petition for anticipatory bail is not maintainable. Accordingly, the same is dismissed.
