2. The petitioner seeks bail in connection with Pasraha P.S. Case No. 249 of 2024 instituted for the offences under Sections 137(2), 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. Allegation against the accused persons including the petitioner is of kidnapping the son of the informant.

4. Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in the present case. Learned counsel further submitted that there is a delay of seven days in lodging the FIR without any plausible explanation, which in itself, raises doubt over the prosecution story. Learned

No specific overt act is alleged against the petitioner. Learned counsel further submitted that on 13.10.2024 a dead body was recovered in part and the same was partly burnt, which the informant allegedly identified as that of her son. Learned counsel further submitted that this petitioner is nowhere connected with the alleged incident and, as a matter of fact, the informant's daughter has herself stated before the police that deceased left the house to watch Ramayan serial and she did not saw the petitioner to have come to her house to call deceased. It has been submitted on behalf of the petitioner that the petitioner is in custody since 17.10.2024 and has no criminal antecedent.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the aforesaid facts and circumstances of the case, there being no cogent material to prove the involvement of the petitioner in the alleged occurrence as also the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of
