JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 13.07.2016 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. It is submitted that petitioner was granted privilege of anticipatory bail vide order dated 11.02.2015 passed in Cr. Misc. no. 5713/2015 in connection with Jamui P.S. Case No. 136 of 2014 with direction to surrender before the Chief Judicial Magistrate, Jamui within four weeks from the date of receipt/production of copy of order dated 11.02.2015 but the concerned lawyer did not communicate the same to petitioner and that was the reason petitioner could not surrender before the court below within prescribed time. Therefore, it is prayed on behalf of the petitioner to extend some more time for surrender.

Patna High Court Cr.Misc. No.28176 of 2016 (2) dt.13-07-2016 2/2 Considering the aforesaid submissions as well as facts and circumstances of the case, let the petitioner surrender before the concerned court within two weeks from today and if the petitioner does so, the concerned court shall pass appropriate order in the light of order dated 11.02.2015 passed in Cr. Misc. no. 5713/2015.

In the aforesaid manner, the above stated order dated 11.02.2015 passed in Cr. Misc. no. 5713/2015 stands modified to the above stated extent and this modification petition stands disposed of.
