JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-01-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 272,273/34 of the Indian Penal Code and 39(a), 38(i),41(i) of Bihar Prohibition and Excise Act, 2016.

18 liters Indian made foreign liquor is said to have been recovered when the petitioner along with one other was coming on a motorcycle. Para-3 of the petition goes to show that prior to institution of the present case, the petitioner was made accused for the offences of Excise Act in Ziradei P.S.Case 40 of 2018 and apart from the aforesaid case, petitioner does have two other cases. However, petitioner is in jail custody since 09.09.2018.
