The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 307, 376 and other allied sections of the Indian Penal Code and section 4/6 of the POCSO Act.
As per the prosecution case, co-accused Ranjit Kumar Yadav committed sexual assault upon the minor daughter of informant. This petitioner and other FIR named accused persons are alleged to have assaulted the informant and her husband. It is submitted that specific accusation of sexual assault is against co-accused Ranjit Kumar Yadav. Although there is allegation in the FIR that petitioner and others assaulted the informant and her husband, but there is no injury report on

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge VI-cum-Special Judge, POCSO Court, Supaul/Incharge successor Court in connection with Jadia P.S. Case No. 319 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
