JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 18-08-2020 Heard Mr. Alok Kumar Alok, learned counsel appearing on behalf of the petitioner and Mr. Anzarul Haque Sahara, learned Additional Public Prosecutor, for the State of Bihar.
The petitioner was allowed regular bail by an order 09.06.2020, passed in Cr. Misc. No. 18811 of 2020 on furnishing sureties/bonds to the satisfaction of learned XI Addl. Sessions Judge, Muzaffarpur, in Sadar P.S. Case No. 417 of 2018. Satisfaction of learned XI Addl. Sessions Judge, Muzaffarpur was mentioned in the order on the basis of the averments made in the application to the effect that the matter was pending before learned Addl. Sessions Judge- XI.
Present
application has been filed seeking
2/3 modification of the said order only to the extent that in place of learned Addl. Sessions Judge-XI, satisfaction of learned Chief Judicial Magistrate, Muzaffarpur be read in the said order dated 09.06.2020 passed in Cr. Misc. No. 18811 of 2020. Considering the statement made in paragraph 5 of the application that the case is presently pending before learned Chief Judicial Magistrate, Muzaffarpur, the said order dated 09.06.2020 is modified and it is accordingly directed that in place of satisfaction of learned Addl. Sessions Judge-XI, satisfaction of learned Chief Judicial Magistrate shall be read in the said order dated 09.06.2020 passed in Cr. Misc. No. 18811of 2020 in connection with Sadar P.S. Case No. 417 of 2018. It is directed that defects pointed out by the stamp reporter, be removed within two months.
Since there is a lockdown, the Court has considered it appropriate to adopt following procedure for communication of the present order:- (i) The order, which has been dictated during the course of the proceedings of virtual Court, shall be communicated to me on my e-mail I.D. by the Secretary. (ii) The corrected copy of the order shall be transmitted by me from my e-mail I.D. to the Secretary, which
3/3 shall be treated to be the authentic copy of the order passed by this Court today in the present proceeding.
(iii) Hard copy of the order, duly signed by me, shall be preserved in my residential office for documentation and future use, if any.
(iv) Let a copy of the order be communicated to the learned court below through e-mail or any other appropriate electronic mode by the Registry.
Let steps be taken by the Registry for uploading of the present order without compromising with the norms of social-distancing.
