Petitioner is in custody in connection with Nauhatta P.S. Case No. 128 of 2018 for the offence under sections 363, 366A/34 of the Indian Penal Code.

Considering the fact that petitioner has no criminal antecedent and the girl in her statement under section 164 Cr.P.C. has admitted that she has accompanied this petitioner at her volition and it is true that victim is 16 years old and she was not forced to accompany the petitioner as per submission of counsel for the petitioner, the Court is inclined to grant bail to the petitioner as he is a student, aged about 18 years, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like

Patna High Court Cr.Misc. No.80462 of 2018(2) dt.15-01-2019 2/2 amount each to the satisfaction of J.M. 1st Class, Saharsa, in connection with Nauhatta P.S. Case No. 128 of 2018 subject to the condition that one of the bailors should be government employee and other local people where petitioner usually resides.
