This is an appeal under Section 14(A)(ii) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 2016 (hereinafter referred to as the "SC/ST Act") against the refusal of prayer for regular bail vide order dated 28.02.2024 passed by the learned exclusive Special Judge SC/ST, Saran at Chapra in Dariyapur P.S. Case No.181 of 2022, F.I.R. dated 05.04.2022 registered under Sections 302,120(B)/34 of the Indian Penal Code and Section 3(2)(v) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

3. Earlier the prayer for bail of the appellant was rejected vide order dated 11.08.2023 passed in Cr. Appeal (SJ) No.1691 of 2023.
4. Vide order date dated 10.04.2024, a report was called for with regard to the present status of the trial. Report of the learned Trial Court dated 22.04.2024 reveals that out of seven chargesheet witnesses, four witnesses have already been examined and the case is pending for the examination of the rest of the prosecution witnesses.
5. Considering the nature of allegation as alleged in the FIR, material has come during investigation against the petitioner and the report of the learned Trial Court, I am not inclined to enlarge the appellant on bail in connection with Dariyapur P.S. Case No.181 of 2022 pending in the court of learned exclusive Special Judge SC/ST, Saran at Chapra.
6. Prayer is refused.
7. However, the learned Trial Court is directed to expedite the trial and conclude the same at the earliest. (Rajesh Kumar Verma, J) Nitesh/- U T
