JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-01-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 341, 323, 376/34 of the Indian Penal Code and 4 of POCSO Act.

The allegation of sexual assault against the accused Amarnath, who happens to be son of the petitioner. The accusation against the petitioner is that he asked the informant's father for abortion and when the informant's father refused to buckle from the aforesaid pressure, the petitioner and others assaulted him.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this
