The petitioners apprehend their arrest in Complaint Case No. 623C of 2014 registered for the offences punishable under Sections 354, 380, 509 and 323 of the Indian Penal Code. The complainant alleged that the petitioner came to her house to enquire about her husband when the complainant disclosed that her husband had gone outside the village after taking passengers on his vehicle on such the petitioner is said to have caught her hand. After sometime the petitioner again came, along with other accused persons and assaulted the informant and snatched her ornaments.
Learned counsel for the petitioners submits that the
Patna High Court Cr.Misc. No.26009 of 2017 (2) dt.07-07-2017 2/2 occurrence is said to have taken place on 31.05.2014 but the complainant filed the complaint case on 04.06.2014. The petitioner Md. Wajeer @ Bazir @ Wozeer filed Kishanganj P.S. Case No. 236 of 2014 on 15.05.2014 that he broke bamboo of Md. Hanif as he got injury on such Md. Hanif brutally assaulted him. Md. Hanif is the husband of the complainant and the complainant, herself, filed this false case.
Considering the facts aforesaid the petitioners above named in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Kishanganj in Complaint Case No. 623C of 2014, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
