It has come at the instance of the petitioner and submission is that as a matter of fact, petitioner no.2 was arrested during pendency of this application, but by mistake submission has been made that petitioner no.1 was arrested and as such this application with respect to petitioner no.1 was dismissed as withdrawn and petitioner nos.2 and 3 were granted anticipatory bail.

Considering the facts and circumstances as stated above, order dated 18.01.2019 is modified to the extent that application with respect to petitioner no.2, who was arrested

Patna High Court Cr.Misc. No.1283 of 2019(3) dt.30-01-2019 2/2 during pendency of this application is dismissed as withdrawn. Heard learned APP also.

So far petitioner no.1 is concerned, there is general allegation against him and as such petitioner nos.1 & 3, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Jhanjharpur, Madhubani, in connection with Lakhnour P.S. Case No. 209 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.

Let this modification order be communicated to the court concerned at once.
