JUSTICE ARVIND SRIVASTAVA ORAL ORDER 07-06-2017 Heard learned counsel for the petitioner, Mr. Abhishek Kumar and the learned A.P.P. for the State. The petitioner apprehends his arrest in connection with Ghorasahan P.S. Case No. 45 of 2017 registered under Section 30(a) of the Bihar Prohibition and Excise Act. Learned counsel appearing on behalf of the petitioner submits that petitioner is quite innocent and has falsely been implicated in this case. Further submission is that it would appear from the F.I.R. itself that nothing has been recovered from the conscious possession of the petitioner, rather the alleged recovery was made at the distance of 8-10 meters far from the house of the petitioner and the petitioner has no criminal antecedent. Case No. 45 of 2017, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
