The petitioner is in custody in connection with Sherghati (Dobhi) P.S. Case No. 553 of 2018 (G.R. No. 6676 of 2018), registered for the offence punishable under Sections 272/273/414/34 of the Indian Penal code and Section 30 (a) of the Bihar Excise & Prohibition Act, 2016.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. He further submits that petitioner is driver of the vehicle having no knowledge about the loaded bag contains wine. Learned counsel for the petitioner further submits that petitioner is in custody in this case since 1.10.2018.

Considering the facts that petitioner has no criminal

No.79657 of 2018(2) dt.15-01-2019 2/2 antecedent and he is in custody since1.10.2018, let the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Special Judge, (Excise) Gaya in connection with Sherghati (Dobhi) P.S. Case No. 553 of 2018 ( G.R. No. 6676/18).
