The petitioner apprehends his arrest in connection with Khutauna P.S. Case No. 24 of 2016, registered for the offences punishable under Sections 413, 414, 401 of the Indian Penal Code.

Allegedly, co-accused Ranjeet Yadav and Ramanand Yadav were arrested and stolen motorcycles have been recovered from their possession, who stated the names of other-accused including the petitioner that petitioner used to prepare documents with respect to stolen and looted motorcycles. Submission is of false implication and that nothing has been recovered from possession of the petitioner, the

No.26435 of 2017 (2) dt.07-07-2017 2/2 confessional statement of co-accused made before the police has got no evidentiary value in the eye of law and besides confessional statement there is no other legal material against the petitioner and, as such, the petitioner deserves sympathetic consideration. The learned A.P.P. submits that co-accused Ranjeet Yadav has stated the name of the petitioner regarding his involvement in the crime.

In the facts and circumstances as stated above, the petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. Jhanjharpur, Madhubani, in connection with Khutauna P.S. Case No. 24 of 2016, subject to the conditions as laid down in section 438(2) of the Cr.P.C. (Jitendra Mohan Sharma, J.) Rajiv/- U T
