The petitioner is apprehending his arrest in connection with Biraul P.S.Case No.283 of 2018 , registered for offences punishable under Sections 341, 323, 324, 307, 379, 504/34 of the Indian Penal Code.

Allegation against the petitioner is of assault to the informant by Farsa.

Submission of the learned counsel for the petitioner is that there is case and counter case and he has drawn my attention towards the discharge slip issued by DMCH, which is Annexure 5 to this petition that shows that the injured got himself discharged on his own very next day with medical advice and the injury is not grievous in nature. Heard learned A.P.P. also.

No.22387 of 2019(2) dt.08-04-2019 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Darbhanga in connection with Biraul P.S.Case No.283 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure. With the aforesaid observation, this application is allowed.
