JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 31-08-2022 At the outset, learned counsel for the petitioners seeks permission to withdraw this anticipatory bail application in respect of petitioners no.1 and 2, namely, Sunil Sahni @ Sunil Kumar and Kailash Sahni.
Permission is granted.
Accordingly, this anticipatory bail application is dismissed as withdrawn so far as petitioners no.1 and 2 are concerned.
Heard learned counsel for the petitioner and learned APP for the State.
Petitioner No.3 apprehends his arrest in connection with Suppi P.S. Case No.222 of 2021, registered for the offences punishable under Sections 25(1-b)a, 26, 35 of the Arms Act.
Patna High Court CR. MISC. No.24678 of 2022(2) dt.31-08-2022 2/2 Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. Petitioner No.3 has got two criminal antecedents as stated in paragraph-3 of the bail application. It is further submitted that there is general and omnibus allegation against the petitioner. Nothing has been recovered from the house of the petitioner. It is submitted that petitioner is neither the family members of Sunil Sahni nor Kailash Sahni.
Learned APP for the State opposed the prayer for anticipatory bail of the petitioner no.3.
Taking into consideration the facts aforesaid, let petitioner no.3, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Suppi P.S. Case No.222 of 2021, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
