JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 05-11-2015 Heard learned counsel for the petitioners and the State.

The petitioners apprehend their arrest in a case under Sections 436/34 of the Indian Penal Code.

The petitioners are landlord of the informant, who has his shop in their house.

Learned counsel for the petitioners submits that it is not the informant's case that he has seen the petitioners setting fire to his shop. Furthermore, the police in his report stated that no one has seen as to who has set fire the shop. Besides this, the petitioners submit that in no circumstances they would set their own house on fire.

In the circumstances, in the event of arrest or

Case no. 366 of 2015 subject to the conditions as laid down under Section 438 (2) Cr.P.C.
