JUSTICE VIKASH JAIN ORAL ORDER 23-09-2015 Heard learned counsel for the petitioner and learned APP for the State assisted by learned counsel for the opposite party no.2.

2. The petitioner apprehends his arrest for the offences alleged under Sections 498A of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act registered in connection with Paraiya P.S. Case No.25 of 2014.

3. It is submitted that the petitioner, a person of clean antecedents, has been falsely implicated. In any event he offers to deposit an amount of Rs.1000/- per month regularly for the benefit of opposite party no.2.

4. Having regard to the entirety of the facts and circumstances of the case, the provisional anticipatory bail granted to the petitioner by order dated 02.12.2014 pending in the Court of learned Chief Judicial Magistrate, Gaya in connection with Paraiya P.S. Case no.25 of 2014 shall stand confirmed subject to the conditions as laid down under Section 438 (2) Cr.P.C., with additional condition that the petitioner will deposit a sum of Rs.1000/- per month regularly before the learned Court below which shall be available for withdrawal by the opposite party no.2 and upon failure to deposit any two consecutive instalments, his bail bond shall stand automatically cancelled.
