The petitioner apprehends his arrest in Beldour P.S. Case No.175 of 2016 registered under Sections 341, 342, 323, 379, 504, 506 and 34 of the Indian Penal Code and Section 27 of the Arms Act.
The learned counsel for the petitioner submits that petitioner is of course named in the F.I.R. but no specific allegation is made against the petitioner. Similarly situated ten persons have been granted anticipatory bail vide order dated 22.09.2017 passed in Cr. Misc. No.43906 of 2017 and two persons namely, Sanjay Yadav and Mritunjay Yadav have also been granted anticipatory bail vide order dated 14.07.2017 passed in Cr. Misc. No.31394 of 2017.
Considering the fact that the case of the petitioner
Patna High Court Cr.Misc. No.696 of 2019(2) dt.16-01-2019 2/2 stands on the same footing as that of the accused persons who have been granted anticipatory bail, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Smt. Simmi Kujoor, the learned First Class Magistrate, Khagaria in connection with Beldour P.S. Case No.175 of 2016(G.R. No.2385 of 2016), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
