JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 08-09-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Bibhutipur P.S. Case no. 38 of 2016, registered under Sections 406 and 420 of the Indian Penal Code.

The allegation of informant Satya Narayan Paswan, Revenue Employee is that petitioner being the social worker used to visit in the village Surauli and he issued certificate of land ownership and rent receipts by putting the forged signature of Circle Officers and local revenue Karamchari and he also gave LPC to Nandeshwar Prasad, Chairman of PACS, which was also forged. Learned counsel for the petitioner submits that, in fact, due to some dispute, the informant has implicated the petitioner in this case. Further submission is that in para 5 of the case diary, the informant stated in his statement recorded under Section 161 Cr.P.C.

Patna High Court Cr.Misc. No.26387 of 2017 (3) dt.08-09-2017 2/2 that he had filed the present case on the pressure of Circle Officer and the revenue receipts, which are said to be forged, were found genuine. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the ACJM-III, Rosera (Samastipur) in connection with Bibhutipur P.S. Case No. 38 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
