====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 03-12-2021 Heard the learned Advocate for the petitioner and the learned APP for the State.

The petitioner seeks bail in connection with Ghoshwari Samayagarh (O.P.) P. S. Case No.129 of 2020, instituted for the offences under Sections 25(1-B)a, 26 and 35 of the Arms Act.

The learned counsel for the petitioner submits that the petitioner is in custody since 23.10.2020, he is a person with clean antecedent, charge-sheet has been submitted in this case. The learned counsel for the petitioner further submits that from perusal of the allegation as alleged in the F.I.R., it would manifest that the informant alleges that one country-made rifle .303 bore, one magazine, four live cartridges of .303 bore and six live cartridges of pistol were recovered from the side of

Patna High Court CR. MISC. No.35439 of 2021(2) dt.03-12-2021 2/2 Godrej Alimrah in the house of the petitioner. The learned counsel for the petitioner submits that the house is a joint property and he is not living in the house. Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody since 23.10.2020, he is a person with clean antecedents, chargesheet has been submitted in this case, the petitioner, abovenamed, is directed to be released on bail on his furnishing bailbonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri K. P. Arya, learned Judicial Magistrate, Barh, Patna in connection with Ghoshwari Samayagarh (O.P.) P. S. Case No.129 of 2020. The application stands allowed.
