JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-10-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 414 of the Indian Penal Code.

The petitioner was intercepted with the motorcycle suspected to be stolen one when this petitioner alleged that he took the motorcycle from co-accused Chandan Kumar and went to bring the papers of the motorcycle but did not return.

It is submitted by learned counsel for the petitioner that accusation appears to be absolutely unreasonable as the seizure of the motorcycle was made on 31.08.2014 but the F.I.R was registered on 26.09.2014. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the delayed lodging of the F.I.R which clouds the bona fide of the accusation, let the petitioner,

Patna High Court Cr.Misc. No.40040 of 2015 (2) dt.06-10-2015 2/2 above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheikhpura in connection with Sheikhpura(Sirari O.P.) P.S. Case No. 391 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
