ANJANA MISHRA ORAL ORDER 31-08-2016 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.

The petitioners apprehend their arrest in connection with Desari (Chandpura O.P.) P.S. Case No. 82 of 2016 for the offences registered under Sections 147, 148, 149, 447, 341, 342, 323, 324, 325, 307, 379, 504 of the Indian Penal Code. Learned counsel for the petitioners submits that there is case and counter case between the parties and that the injuries have been found to be simple in nature. It is further submitted that prior to the filing of the present case, petitioner no. 1 has lodged a case against the informant.

Patna High Court Cr.Misc. No.30364 of 2016 (2) dt.31-08-2016 Considering the facts and circumstances of the case and also the fact that the petitioners have no criminal antecedent, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Desari (Chandpura O.P) P.S. Case No. 82 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
