ANJANA MISHRA ORAL ORDER 10-07-2017 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.
The petitioners apprehend their arrest in connection with Bousi P.S. Case No. 17 of 2017 for the offences registered under Sections 363, 366(A)/34 of the Indian Penal Code. Learned counsel for the petitioners submits that the petitioners have falsely been implicated in this case and the main allegation of kidnapping is against Ramanand Singh and not the present petitioners. However, in the statement under Section 164 Cr.P.C. these three petitioners have also been named by the victim girl. It is further submitted that another such persons similarly named by the victim girl in her statement has since been extended the privilege of anticipatory bail vide
Patna High Court Cr.Misc. No.27025 of 2017 (2) dt.10-07-2017 order dated 11.05.2017 passed in Cr. Misc. No. 19354 of 2017. Considering the aforementioned facts and circumstances of the case and that the case of the petitioners stand on similar footing, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate -VI, Araria in connection with Bousi P.S. Case No. 17 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
