The petitioners are in custody since 15.01.2019 in connection with Hathauri P.S. Case No. 264 of 2018 for the offence registered under Section 379 of the Indian Penal Code. Learned counsel for the petitioners submits that for the theft of same motorcycle, two cases were lodged one being Katra P.S. Case No. 275 of 2018 and also the present case being Hathauri P.S. Case No. 264 of 2018. It is further submitted that the petitioners were taken into custody in connection with Katra P.S. Case No. 275 of 2018 and in the said case, they have been

Patna High Court CR. MISC. No. 24883 of 2019(2) dt.18-04-2019 2/2 granted bail. However, petitioners were remanded in connection with the present case on 15.01.2019 and are languishing since then.

Considering the aforesaid facts and circumstances of the case and that the petitioners have no other criminal antecedents but for these two cases which relates to the same offence, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJMcum-Sub Judge, 10th Muzuffarpur in connection with Hathauri P.S. Case No. 264 of 2018.
