This application, for grant of regular bail, arises out of Chhapra Town P.S. Case No.571 of 2020, registered for the offences punishable under Sections 30(a)/41(i)(ii) of the Bihar Prohibition and Excise Act, 2016.

The learned counsel for the petitioner submits that petitioner is in custody since 20.02.2021 and charge-sheet has been submitted. Learned counsel for the petitioner further submits that from allegation, as alleged in the FIR, it would be manifest that 102 litres of country made liquor has been recovered from the possession of the petitioner. Learned APP vehemently opposed the prayer for bail.

No.27725 of 2021(3) dt.22-11-2021 2/2 Considering the fact that charge-sheet has been submitted against the petitioner and he is in custody since 20.02.2021, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 5,000/- (five thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Session Judge-cumSpecial Judge, Excise, Saran, in connection with Chhapra Town P.S. Case No.571 of 2020.
