The petitioners apprehend their arrest in Maheshi P.S. case No. 134 of 2015 under Section 307 and other Sections of the Indian Penal Code.
The informant alleged that he was sitting on protest against the accused persons, who earlier assaulted the informant and others, but again the petitioners and other accused persons, resident of village Pastwar, came and brutally assaulted the informant and others.
It is alleged that entire allegation is false and concocted. All the injured got simple injuries. There was some altercation between the villagers of two villages and for that this
Patna High Court Cr.Misc. No.28000 of 2016 (2) dt.02-09-2016 2/2 false case has been lodged. Similarly situated accused Jiwachh Paswan and 17 others have already been granted anticipatory bail vide order passed in Cr. Misc. 16 of 2016. Accused Bijay Paswan has been granted regular bail vide order passed in Cr. Misc. No. 47895 of 2015.
It appears that case of petitioners stands on same footing as that of accused Jiwachh Paswan and others. Considering the facts aforesaid and the nature of allegations made against the petitioners, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in Maheshi P.S. Case No. 134 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
