JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 14-09-2016 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Karamchat Police Station Case No. 32 of 2016, disclosing offences under Sections 147, 148, 297, 295A, 353, 341, 323, 307, 504 and 506 of the Indian Penal Code. Disharmony between two religious groups has led to the occurrence, as alleged in the First Information Report, lodged on the basis of the written report of the Block Development Officer, Rampur, Kaimur.

The petitioners are said to have attacked the police party, which had gone to prevent any untowards incident.

Learned Counsel for the petitioners has submitted that the allegations are vague. He has also

No.36882 of 2016 (2) dt.14-09-2016 2/2 submitted that the petitioners have not committed any offence, as alleged in the First Information Report, and that in future also, they will not indulge in such activities. Considering the above submission, this application is allowed.

Let the petitioners, namely, Muni Ram, Mukesh Kumar, Ram Pravesh Ram, Bal Kishun Ram and Ram Karn Sah, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Bhabhua, in connection with Karamchat Police Station Case No. 32 of 2016, subject to the condition laid down under Section 438

(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
