The petitioners are apprehending their arrest in a case registered under Sections 147, 149, 341, 323, 307, 379 and 504 of the Indian Penal Code.

The prosecution case is that the accused persons assaulted the informant with lathi, rod and hockey stick and on alarm when four villagers came to rescue the informant they were also assaulted by the accused persons and the accused persons also snatched mobile phone and Rs.1200/- from the informant.

Patna High Court Cr.Misc. No.28200 of 2016 (2) dt.13-07-2016 It is submitted by learned counsel for the petitioners that the allegation of assault is omnibus and general in nature in the background of panchayat election dispute and the injuries were found to be simple.

Considering the accusation in the background of dispute with regard to panchayat election, let the above named petitioners be released on anticipatory bail, in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad (Bihar), in connection with Kutumba P.S.Case No. 36/2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
