30-01-2019 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is in custody since 30.05.2018 in connection with Baliya P.S. Case No. 143 of 2018 for the offence registered under Sections 8, 20(b)(ii)(c), 25/29 of the N.D.P.S. Act.

Learned counsel for the petitioner submits that the alleged recoveries were not from the conscious possession of the petitioner. He is merely a labourer, who collects at the public place for taking up labour jobs from vehicles which go and unload their goods at the particular place of occurrence. It is further submitted that though the petitioner is named in the first information report, the petitioner was arrested along with other accused persons, who have since been extended the privilege of

Patna High Court Cr.Misc. No.79541 of 2018(2) dt.30-01-2019 2/2 regular bail vide order dated 08.10.2018 passed in Cr. Misc. No. 61363 of 2018 and also vide order dated 31.10.2018 passed in Cr. Misc. No. 60108 of 2018. It is further submitted that the petitioner's case stands on similar footing and as such, he may also be extended the same benefit.

Considering the aforesaid facts and circumstances of the case and that the petitioner has no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Court of Sessions Judge, Begusarai. in connection with Baliya P.S. Case No. 143 of 2018.
