The petitioner apprehends his arrest in a case under Sections 379, 323 and other sections of the Indian Penal Code. The informant alleged that while he was ploughing his land with a tractor, the petitioner and others came. The petitioner is alleged to have assaulted the son of the informant with Khanti on his head and the petitioner is also alleged to have snatched a chain made of gold from the possession of the son of the informant. It is submitted that there is a counter-version. Urmila Devi, wife of Awadhesh Singh @ Sahdu Singh lodged a case against the informant and others being Belaganj P.S. Case No. 123/2015. There is a land dispute between the parties. The injury is simple in nature and the allegation of theft is ornamental. Considering the facts aforesaid, the above named
Patna High Court Cr.Misc. No.40924 of 2015 (2) dt.06-10-2015 2/2 petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in Belaganj P.S. Case No. 122/2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
