JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 09-11-2020 Heard learned counsel for the petitioner and learned APP for the State through virtual court proceedings. The petitioner seeks bail in a case registered for the offence punishable under Sections 307 of the Indian Penal Code and 27 of the Arms Act.

Allegation against the petitioner along with other unknown accused persons is of assaulting the victim by the gun shot.

Learned counsel for the petitioner submits that the FIR has been lodged against unknown persons, the name of the petitioner and others surfaced during investigation. The petitioner is in custody since 12.04.2019. The co-accused have been granted bay by different Co-ordinate Benches of this Court vide order dated 18.01.2019 passed in Cr. Misc. No.7993 of

Patna High Court CR. MISC. No.21641 of 2020(6) dt.09-11-2020 2/2 2018, vide order dated 15.01.2019 passed in Cr. Misc. No. 7949 of 2018 and vide order dated 04.03.2020 passed in Cr. Misc. No. 14986 of 2020.

Learned APP for the State opposes the prayer for bail petition.

Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail after framing of the charge on furnishing bail bond of Rs. 25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. District and Sessions Judge-IIIrd, Kaimur at Bhabhua, in connection with Adhaura P.S. Case No. 46 of 2018.
