1. Heard learned counsel for the appellants and learned Special P.P. for the State, Mr. Sadanand Paswan no one appears on behalf of the Respondent No. 2.
2. This is an appeal under Section 14-A(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (hereinafter referred to as the "SC/ST
Patna High Court CR. APP (SJ) No.1392 of 2025(5) dt.20-07-2026 2/3 Act") against the refusal of prayer for anticipatory bail vide order dated 17.03.2025 in A.B.P. No. 550 of 2025 passed by the learned 1st Additional Sessions Judge-cum-Special Judge S.C./S.T. (POA) Act, Aurangabad in connection with Risiup P.S. Case No. 22 of 2025 registered for the offences punishable under Sections of the Indian Penal Code as well as Sections 115(2), 126(2), 117(2), 352 of the BNS, 2023 and under Sections 3(1)(r) and 3(1)(s) of the SC/ST Act.

Learned counsel for the appellants submits that appellants are persons with clean antecedent and the informant alleges that on 03.03.2025 at 07:30 PM, he had gone to the shop of Birendra for purchasing some articles, where 11 named accused persons including the seven appellants herein were sitting in the shop who abused and assaulted him, further Dipul assaulted Bimlesh by kada (iron bracelet) who came to save him causing injury on head.

Learned counsel appearing on behalf of the appellants submits that appellants have been falsely implicated in the instant case by the informant, it is next submitted that from perusal of the allegation as alleged in the FIR, it would manifest that allegation of abuse and assault in general and omnibus in nature, it is also submitted that it does not appear
Patna High Court CR. APP (SJ) No.1392 of 2025(5) dt.20-07-2026 3/3 probable that all accused in one go would have abused the informant by taking caste name and as far as allegation of assault is alleged, the same is specific against Dipul who is not an appellant in the instant appeal.
5. Learned Special P.P. for the State opposes the appeal.

In view of the submissions made by the learned counsel for the appellants, the order dated 17.03.2025 is hereby set aside and the appellants above-named, in the event of their arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned Trial Court where the case is pending/successor court in connection with Risiup P.S. Case No. 22 of 2025 subject to the conditions as laid down under Section 482 (2) of the BNSS.
7. Accordingly, the appeal stands allowed.
