JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-01-2019 Heard learned counsel for the petitioners as well as learned Addl. Public Prosecutor for the State. Petitioners seek bail in a case registered under section 414 of the IPC and section 30(a) of Bihar Prohibition and Excise Act.

Petitioners are said to have been caught on the spot when the informant and other police officers intercepted one Maruti Suzuki Wagon R and one motorcycle. The occupants of the aforesaid Maruti Suzuki Wagon R and motorcycle started fleeing from the place of the occurrence. However, there was stampede like situation and in that situation, petitioners were caught by the informant. The written report does not say any

No.80157 of 2018(2) dt.17-01-2019 2/2 recovery of foreign liquor but seizure list attached with the written report goes to show that near about 95.76 liters foreign liquor were recovered from Maruti Suzuki Wagon R. So far as the petitioners are concerned, only mobile phones are said to have been recovered from their possession.

Considering the facts and circumstances as well as submissions of the parties, let the above named petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, East Champaran, Motihari in Chakiya P.S. Case no. 295/2018.
